IMPORTANT LEGAL NOTICE: This Agreement affects the legal rights of you and the minor participant. Read it completely before signing. It includes an assumption of risk and a release of certain claims, including ordinary-negligence claims, to the fullest extent permitted by Colorado law, including C.R.S. § 13-22-107.
1. Minor, Guardian, Activity, and Parties
I am the parent or legal guardian of the minor identified in this form and have authority to sign for the minor. I request and authorize the minor to participate in a Liquid Arts glassmaking, glassblowing, torchworking, kilnworking, demonstration, workshop, private lesson, studio session, or related activity, including preparation, instruction, equipment use, movement through the studio, and entry to and exit from the premises (the “Activity”), offered by Elev8 Premier LLC d/b/a Liquid Arts.
“Released Parties” means Elev8 Premier LLC d/b/a Liquid Arts and, solely in connection with the Activity, its owners, members, managers, officers, employees, instructors, independent contractors, agents, volunteers, landlords, premises owners, successors, and assigns.
2. Acknowledgment of Risks
I understand the Activity presents serious inherent and other risks, including extreme heat; molten or hot glass; furnaces, glory holes, kilns, torches, flame, tools, equipment, gases, electricity, and ventilation systems; sharp or broken glass; flying particles; cuts, punctures, burns, scarring, eye injuries, respiratory irritation, heat stress, smoke, fumes, dust, noise, fire, and chemicals; slips, falls, collisions, dropped materials, physical exertion, acts or omissions of participants or others, equipment malfunction, delayed emergency response, property damage, serious injury, disability, disfigurement, or death. This list is illustrative and not complete. Some risks may be unknown or unforeseeable.
3. Permission and Assumption of Risk
I knowingly permit the minor to participate and, on behalf of myself and the minor to the fullest extent permitted by law, accept and assume all inherent and other risks of the Activity, known or unknown, foreseeable or unforeseeable, including risks arising from ordinary negligence.
4. Parent/Guardian Release and Covenant Not to Sue
TO THE FULLEST EXTENT PERMITTED BY COLORADO LAW, INCLUDING C.R.S. § 13-22-107, I, ON BEHALF OF MYSELF AND THE MINOR, RELEASE, WAIVE, AND DISCHARGE THE RELEASED PARTIES FROM, AND COVENANT NOT TO SUE A RELEASED PARTY FOR, CLAIMS ARISING OUT OF OR RELATING TO THE MINOR’S PARTICIPATION IN THE ACTIVITY OR PRESENCE ON THE PREMISES, INCLUDING PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE CAUSED IN WHOLE OR IN PART BY THE ORDINARY NEGLIGENCE OF A RELEASED PARTY.
This Agreement does not release claims that Colorado law does not permit to be released, including gross negligence, reckless conduct, willful or wanton conduct, intentional misconduct, or nonwaivable duties.
5. Safety Responsibilities
I will ensure the minor follows all instructions, warnings, rules, and required procedures; uses required protective equipment and proper clothing/closed-toe footwear; secures hair and loose items; does not participate while impaired or otherwise unsafe; discloses restrictions relevant to safe participation; uses only authorized equipment; reports hazards and injuries; and stops when directed. Liquid Arts may refuse, pause, modify, or end participation when safety is at risk.
6. Emergency Assistance and Costs
If I cannot be reached, I authorize reasonable emergency assistance for the minor. Released Parties are not medical providers and cannot guarantee care. I accept responsibility for medical, ambulance, transportation, and related expenses except where prohibited by law.
7. Colorado Law, Venue, Severability, and Electronic Records
Colorado law governs. To the extent permitted by law, proceedings must be brought in a court of competent jurisdiction in El Paso County, Colorado. Invalid provisions will be limited only as necessary; the remainder stays effective. Electronic records and counterparts may be treated as originals. My checked acknowledgments, typed name, or other electronic signing action are adopted with intent to sign.
